Description of the subject of the contract
a. Brief description of the subject of the contract:
Tests of vehicle of category M3 class I, class II and class III in line with UN and UE Regulations.
b. Purpose of the contract:
Development and verification of a new generation of electric intercity buses using innovative
technologies.
c. Detailed description of the subject of the contract:
The scope of the Contract includes the performance of tests, inspections, measurements, technical assessments and compliance verification activities for M3 category vehicles and their relevant configurations, comprising a total of 32 individual subtasks as specified in the table constituting Appendix No. 1 to the Request for Quotation (Detailed scope of subtasks)
The Contractor shall perform the activities in accordance with the applicable requirements of the regulations and shall provide the corresponding test reports, compliance assessments, checklists and/or other technical documentation necessary to document the results of the work.
Unless explicitly stated otherwise, the scope shall include all activities, equipment and resources necessary to perform the relevant assessment or test and to document its results. The Ordering Party shall provide the test vehicles, vehicle documentation and technical data identified as necessary for the respective activity.
Appendix No. 1 to the Request for Quotation, setting out the Detailed Scope of Subtasks, forms an integral part of the Request for Quotation.
1) Contractor’s Responsibilities
The Contractor shall be responsible for:
a) providing the necessary technical resources and qualified personnel required to perform the tests;
b) preparing and agreeing the schedule for the tests with the Ordering Party;
c) performing the tests in accordance with the scope and requirements of the applicable standards and regulations specified in the Request for Quotation and its appendices;
d) preparing reports presenting the test results, findings and conclusions;
e) cooperating with the Ordering Party’s team throughout the performance of the tests, including during technical arrangements and the review and assessment of the test results.
2) Ordering Party’s Responsibilities
The Ordering Party shall be responsible for:
a) providing the technical data and documentation necessary for the performance of the tests;
b) arranging and covering the costs of transportation of the vehicles subject to testing, i.e. M3 category buses, to and from the test execution site
c) receiving the test results and reviewing the final report;
d) providing, in a timely manner, any information and clarifications necessary for the proper performance of the tests and examinations.
3) Cooperation and Test Execution
a) Communication between the Parties shall be conducted primarily by e-mail and through online meetings.
b) Compliance testing shall be carried out at the Contractor’s facilities, with all related costs included in the price of the service
c) All technical data, documentation, test results and other information exchanged or generated in connection with the performance of the Contract shall be treated as confidential.
d) The Ordering Party’s representatives shall have the right to monitor the performance and progress of the tests, either remotely or on-site at the Contractor’s facilities, subject to prior arrangement with the Contractor.

The estimated timeframes for the completion of the individual subtasks are specified in the table constituting Appendix No. 1 to this Request for Quotation.
The Ordering Party may modify the contract implementation schedule if circumstances occur that reasonably justify such modification.
f. Tender validity period − at least 30 calendar days from the day following the deadline of submission of tenders. At the request of the Ordering Party, the tenderers may be once required to extend the tender validity period by additional 60 days under pain of rejecting the tender.
g. Partial tenders - The Ordering Party does not allow partial offers to be submitted under this announcement. The compliance testing task has been divided into separate orders. Previous orders covered material and strength testing and compliance calculations, while this procurement no. 2026-7175-293252 covers tests performed on complete physical vehicles.
h. Variant tenders - The Ordering Party does not permit the submission of variant tenders.
i. Subcontracting - The performance of any part of the Contract by a subcontractor shall be permitted only with the prior written consent of the Ordering Party, following the identification of the subcontractor and the submission of a detailed description of the scope of work to be entrusted to it. The Contractor shall remain fully responsible for the acts and omissions of any subcontractor as if they were its own.
Equilibrity
Wherever the object of the command is described with the trademarks, patents or origin, source or a specific process it is permitted to apply solutions equal to the described ones under condition that they would have the same or better technical and functional specifications and would not downgrade standards indicated in documentation.
Wherever the object of the command is described by reference to the standards, technical evaluations, specifications or technical reference systems it is permitted to apply solutions equal to the described ones.
Warunki udziału:
Uprawnienia do wykonywania określonej działalności lub czynności: The Contractor hold all authorizations, approvals and/or accreditations required by the relevant competent authorities to perform the compliance tests, inspections, measurements, assessments and other activities covered by the scope of the Contract, as specified in Appendix No. 1 to the Request for Quotation.
The fulfilment of the conditions will be assessed by the declaration submitted by the Contractor Party, constituting Annex 4 to the Request for Proposal.
At the request of the Ordering Party, the Contractor shall, within 48 hours of receipt of such request, submit documents and information confirming the fulfilment of the conditions for participation in the procedure, including, as applicable:
a) copies of the required certificates, authorisations, approvals and/or accreditations.
Wiedza i doświadczenie: The Contractor has relevant experience in performing compliance testing of M3 category vehicles. The Contractor shall demonstrate that, during the last 3 years prior to the deadline for submission of tenders, or, if the Contractor has been operating for a shorter period, during that period, it has successfully completed at least 5 projects, each covering compliance testing against at least 5 of the standards, UN Regulations and/or EU regulations specified in Appendix No. 1 to the Request for Quotation.
The fulfilment of the conditions will be assessed by the declaration submitted by the Contractor Party, constituting Annex 4 to the Request for Proposal.
At the request of the Ordering Party, the Contractor shall, within 48 hours of receipt of such request, submit documents and information confirming the fulfilment of the conditions for participation in the procedure, including, as applicable:
- a list of services/projects performed, including information necessary to verify compliance with the experience requirement, together with documents/references confirming their proper completion; Where, for justified reasons, the Contractor is unable to provide such references, a declaration of the Contractor confirming the proper completion of the relevant services/projects shall be accepted.
Osoby zdolne do wykonania zamówienia: The Contractor's staff team shall consist of at least 2 persons with an engineering background of min. 5 years of experience in performing tests in the automotive industry, functional and performance tests.
The fulfilment of the conditions will be assessed by the declaration submitted by the Contractor Party, constituting Annex 4 to the Request for Proposal.
At the request of the Ordering Party, the Contractor shall, within 48 hours of receipt of such request, submit documents and information confirming the fulfilment of the conditions for participation in the procedure, including, as applicable:
- a list of personnel assigned to the performance of the Contract, including information on their qualifications and professional experience;
Potencjał techniczny: The contractor has the measuring equipment, testing infrastructure, facilities and other technical resources necessary for the proper performance of all tests specified in Appendix No. 1.
The fulfilment of the conditions will be assessed by the declaration submitted by the Contractor Party, constituting Annex 4 to the Request for Proposal.
At the request of the Ordering Party, the Contractor shall, within 48 hours of receipt of such request, submit documents and information confirming the fulfilment of the conditions for participation in the procedure, including, as applicable:
- a list and/or description of the measuring equipment, testing infrastructure, facilities and other technical resources available for the performance of the Contract.
Dodatkowe warunki udziału: Contractors/Suppliers who are personally or financially affiliated with the Ordering Party shall be subject to exclusion from the contract award procedure.
Capital or personal relations shall mean mutual relations between the Ordering Party or persons authorized to enter into commitments on behalf of the Ordering Party or persons performing on behalf of the Ordering Party activities related to the preparation and implementation of procedures for selection of the contractor, or persons who may influence the result of the proceedings and the Contractor, in particular by:
- participation in a partnership, as a partner in a civil law partnership or partnership; holding at least 10% of the shares, unless a lower threshold is required by law; or wasn’t specified by the project managing authority; being a member of the supervisory or management body, acting as proxy;
- being married or in a relationship of direct kinship in a straight line, consanguinity or affinity in the collateral line to the second degree, or being related by adoption, guardianship or custody, either cohabitation with the Contractor, its legal representative or members of the management or supervisory bodies of the Contractors applying for the award of the contract;
- remaining in such a legal or factual relationship with the Contractor that there is reasonable doubt about impartiality or independence in connection with the procurement procedure.
Excluded from participation in the contract award procedure shall be persons performing activities in the contract award procedure or who have been validly sentenced for an offence committed in connection with the contract award procedure, economic or trade-related offences or other offences committed for financial gain.
Compliance with the criterion will be assessed on the basis of a declaration on lack of no capital or personal bonds – Annex 3 to the Request for Proposal.
